The Novartis trial will be one of the largest class gender discrimination trials in the history of the United States. Jury selection in the case is set to begin on Wednesday, April 7, 2010, and the trial is scheduled to last five weeks.

SWH represents a class of approximately 5,600 female sales employees in gender discrimination claims against the 57 billion dollar international pharmaceuticals giant, Novartis Pharmaceuticals Corporation. Novartis Pharmaceuticals Corporation is the American arm of the Swiss corporation Novartis AG, whose CEO recently bragged to the New York Times about paying the French government to move its international borders in order to accomodate his remodelling plans for the Novartis facilities. The Swiss pharma giant is also housed in the country that up through 1971 denied a good portion of its female citizens the right to vote, giving it the dubious distinction of being the very last country in Europe to treat women as equals.

The 5,600 women we represent suffered discrimination in pay, promotions to management, and in the terms and conditions surrounding pregnancy. In sum, Novartis has unlawfully deprived its female employees in America of millions of dollars they had rightfully earned.

Should the female sales representatives prevail at trial, they will request significant and wide-spread changes to:

(1) the way Novartis promotes women into management;
(2) the way Novartis evaluates its employees;
(3) the way Novartis compensates its employees;
(4) the way Novartis investigates and responds to complaints of discrimination and unfair treatment.

Such changes, along with significant monetary relief, will send a message to Novartis as well as other multi-national corporations about the importance of following American equal employment opportunity laws.
